These Terms of Service govern access to and use of the Fennec Creations LLC website, online store, products, services, and related ordering features.

Throughout these Terms, “Fennec Creations,” “we,” “us,” and “our” refer to Fennec Creations LLC. “You” and “your” refer to the person accessing our website, placing an order, or otherwise using services governed by these Terms.

By accessing our website, placing an order, submitting personalization information, approving a proof, or otherwise using services governed by these Terms, you agree to these Terms and any policies or order-specific terms incorporated into them.

Please review these Terms before placing an order.

1. Fennec Creations and Our Sales Channels

Fennec Creations LLC offers personalized, customized, made-to-order, and other merchandise through our website and authorized sales channels.

Our website is currently hosted by Shopify and may use third-party providers for payment processing, product personalization, artwork submission, order management, shipping, analytics, communications, and other functions.

Purchases through the Fennec Creations online store are transactions between the customer and Fennec Creations LLC.

Orders placed through a third-party marketplace or other authorized sales channel may also be subject to that platform’s terms and policies. Where mandatory marketplace requirements conflict with these Terms, those marketplace requirements will control to the extent of the conflict.

2. Eligibility and Customer Information

By placing an order, you represent that you have the legal capacity to enter into the transaction.

You agree to provide accurate, complete, and current information reasonably necessary to process and fulfill your order.

You also represent that you are authorized to use the payment method submitted with the order.

3. Electronic Transactions and Communications

Our website and ordering processes operate electronically.

By submitting an order, approving a proof, accepting a quote, or otherwise entering into an agreement electronically, you consent to the use of electronic records and communications to the extent permitted by applicable law.

Electronic acceptance, approval, records, and signatures may have the same legal effect as their paper equivalents when permitted by law.

4. Orders and Acceptance

Submitting an order constitutes an offer to purchase the products identified in the order subject to these Terms and any additional terms disclosed during the ordering process.

An automated order confirmation acknowledges receipt of the order but does not necessarily mean that every aspect of the order has been accepted for production.

An order may be considered accepted when Fennec Creations expressly confirms acceptance, begins production or customization, or ships the order, as applicable to the circumstances.

Before production, Fennec Creations may review an order and may decline or cancel it when reasonably necessary, including because of:

• product or material unavailability;
• incorrect pricing or product information;
• suspected fraud or unauthorized payment;
• technical or production limitations;
• inability to complete the requested personalization;
• customer-provided content that violates these Terms; or
• another legitimate circumstance that prevents fulfillment as represented.

If we cancel a paid order or portion of an order that we cannot fulfill, we will issue an appropriate refund for the canceled amount.

Nothing in this section limits rights provided by applicable law.

5. Product Information and Availability

We make reasonable efforts to provide accurate product descriptions, specifications, dimensions, materials, colors, photographs, pricing, and other information.

Minor differences may occur because of manufacturing tolerances, materials, personalization processes, photography, lighting, electronic displays, and similar factors.

Product availability, colors, materials, designs, personalization options, and other offerings may change without notice.

Reasonable variations that do not materially affect the quality, function, or intended design of a product are not considered defects.

On-screen previews, mockups, product visualizers, and similar customization tools are intended to assist customers in visualizing their selections. Unless expressly identified as a production proof, they are not guarantees of exact color, scale, curvature, texture, placement, or appearance on the finished physical product.

6. Personalized and Custom Products

Many Fennec Creations products are produced according to information or selections supplied by the customer.

Customers are responsible for reviewing all personalization information before submitting an order, including:

• names and spelling;
• dates and wording;
• photographs;
• logos and artwork;
• colors and sizes;
• fonts and layout selections;
• product options; and
• other customization details.

Products correctly produced according to customer-submitted or customer-approved specifications are subject to the Fennec Creations Return & Refund Policy.

7. Proofs, Approvals, and Changes

Some personalized or custom orders may require a digital proof before production.

When a proof is provided, you are responsible for reviewing the personalization, spelling, layout, artwork, and other visible details before approval.

Approval authorizes Fennec Creations to proceed with production according to the approved proof.

Customer-submitted errors accurately reproduced and clearly visible in an approved proof generally do not constitute production errors by Fennec Creations.

When no proof is provided, an order may be produced according to the information and selections submitted during ordering.

If you request a change after submitting an order, please contact us as soon as possible. Changes cannot be guaranteed after design work, personalization, or production has begun.

Additional charges may apply when an approved change requires substantial additional design or production work. Any additional charge will be communicated before the additional work is performed.

8. Customer-Provided Content

You retain whatever ownership rights you lawfully hold in photographs, artwork, logos, text, designs, and other content you provide to Fennec Creations.

By submitting content for an order, you grant Fennec Creations a limited, non-exclusive, royalty-free license to reproduce, resize, crop, adjust, convert, arrange, transmit, print, and otherwise process that content only as reasonably necessary to:

• prepare and produce your order;
• provide previews or proofs;
• fulfill and deliver your order;
• provide customer support;
• correct or replace an affected product; or
• maintain records reasonably required for business or legal purposes.

You also authorize Fennec Creations to permit service providers acting on our behalf to process the content to the limited extent reasonably necessary to provide those services.

Submitting content for order fulfillment does not automatically give Fennec Creations permission to use your photographs, artwork, logos, personalized designs, or other submitted materials for advertising, social media, portfolios, or unrelated promotional purposes.

Promotional permission may be requested separately.

9. Rights and Permissions for Submitted Content

By providing photographs, artwork, logos, trademarks, text, designs, or other content, you represent that you own the content or otherwise have sufficient permission or legal authority for Fennec Creations to use it as requested.

You may not knowingly submit content that infringes another person’s copyright, trademark, privacy, publicity, or other legal rights.

Fennec Creations may request additional information or authorization when ownership or permission is unclear and may decline production when we reasonably believe fulfilling a request could violate another person’s rights or applicable law.

10. Prohibited or Unacceptable Content

Fennec Creations may refuse to create or reproduce content that we reasonably determine is:

• unlawful;
• infringing or counterfeit;
• threatening, harassing, or defamatory;
• hateful, discriminatory, or degrading toward a person or group;
• sexually exploitative or otherwise unlawful;
• intended to facilitate fraud, deception, or impersonation; or
• otherwise inconsistent with reasonable Fennec Creations business or brand standards.

If an order is declined under this section, amounts already paid for work that will not be performed will be refunded as appropriate.

11. Pricing, Payment, and Taxes

Prices are displayed in the currency shown through the applicable sales channel and may change before an order is placed.

We make reasonable efforts to maintain accurate pricing. If an obvious pricing, listing, or calculation error affects an order, we may contact the customer to resolve the issue or cancel the affected item and issue an appropriate refund.

Payment must be made using an accepted payment method available through the applicable ordering process.

By submitting payment information, you represent that you are authorized to use the payment method and authorize the charges associated with the order.

Payment processing may be performed by third-party payment providers. Fennec Creations does not necessarily receive or retain complete payment-card information.

Applicable sales, use, and other transaction taxes will be collected when required by law.

12. Discounts and Promotions

Discount codes, promotions, and special offers may have separate terms, expiration dates, product restrictions, minimum purchase requirements, or other conditions disclosed with the offer.

Unless otherwise stated:

• discounts have no cash value;
• discounts generally cannot be applied retroactively;
• multiple promotions may not be combined; and
• promotions may be modified or discontinued before an order is placed.

Fennec Creations may correct or reject improper, fraudulent, or unauthorized promotional use when reasonably necessary and permitted by law.

13. Shipping, Delivery, and Local Pickup

Processing times, production times, shipping methods, carrier transit estimates, shipping addresses, delayed shipments, lost or damaged packages, and local pickup are governed by the Fennec Creations Shipping Policy, which is incorporated into these Terms.

Selecting expedited carrier service does not automatically shorten production time unless expedited production is expressly offered or agreed to.

Complimentary local pickup may be available by prior arrangement at The RIM Shopping Center in San Antonio, Texas, near Six Flags Fiesta Texas, as described in the Shipping Policy.

Local pickup must be arranged and confirmed before an order is placed unless an approved sales channel expressly provides another pickup process.

Local pickup is not available at Fennec Creations’ private production location.

14. Returns, Refunds, Exchanges, and Cancellations

Returns, refunds, replacements, exchanges, damaged or defective products, customer-submitted errors, and order cancellations are governed by the Fennec Creations Return & Refund Policy, which is incorporated into these Terms.

Personalized, customized, and made-to-order products are generally final sale when correctly produced according to customer-submitted or customer-approved specifications.

Nothing in these Terms eliminates rights or remedies that cannot legally be waived.

15. Business, Bulk, and Special Orders

Business, bulk, event, wholesale, and specially quoted orders may be subject to additional written terms concerning matters such as:

• pricing;
• deposits or payment schedules;
• minimum quantities;
• personalization and proofs;
• production schedules;
• shipping, delivery, or pickup;
• cancellation;
• intellectual property;
• replacement or correction; and
• other project-specific requirements.

Additional terms may appear in a quote, invoice, order agreement, proof approval, or other written communication provided before the applicable commitment is made.

When accepted by the customer, those additional terms govern the applicable order to the extent they expressly differ from these general Terms.

16. Fennec Creations Intellectual Property

Unless otherwise indicated, the Fennec Creations website and original materials created by or for Fennec Creations, including our business and brand names, logos, brand marks, mascot artwork, original graphics and illustrations, product photography, website copy, and original designs, are owned by or licensed to Fennec Creations LLC and may be protected by applicable intellectual-property laws.

Purchasing a physical product does not, by itself, transfer ownership of the underlying Fennec Creations artwork, design, branding, or other intellectual property or grant permission to reproduce, distribute, license, sell, or commercially exploit that material.

Customer-owned content remains governed by the Customer-Provided Content provisions above.

17. Website Use

You may use the Fennec Creations website only for lawful purposes.

You may not:

• interfere with the operation or security of the website;
• attempt unauthorized access to accounts, systems, or data;
• introduce malicious code or harmful technology;
• knowingly submit fraudulent orders or payment information;
• impersonate another person or entity;
• unlawfully scrape or extract protected website content;
• use the website to violate intellectual-property or other legal rights; or
• otherwise use the website unlawfully or materially interfere with its intended operation.

We may restrict access when reasonably necessary to protect Fennec Creations, our customers, our systems, or third parties.

18. Third-Party Services and Links

Our website may use or link to third-party services, including ecommerce hosting, personalization tools, payment processors, shipping carriers, analytics providers, social media platforms, and other technology providers.

Those parties may maintain their own terms, privacy practices, service requirements, and availability.

Fennec Creations remains responsible for its own obligations to customers but does not control the independent operation of third-party services.

We may change or replace third-party providers as our business and technology needs evolve.

19. Privacy

Our collection, use, disclosure, and protection of personal information are described in the Fennec Creations Privacy Policy.

Information reasonably necessary to process, personalize, fulfill, deliver, support, or protect an order may be shared with appropriate service providers as described in that policy.

20. Reviews and Feedback

If you voluntarily submit a product review, testimonial, suggestion, or other feedback intended for publication, you grant Fennec Creations permission to reproduce, display, and reasonably format that submission for the purpose for which it was provided.

We may decline or remove content that is unlawful, fraudulent, abusive, unrelated, contains inappropriate private information, or otherwise violates reasonable review standards.

This section does not grant Fennec Creations promotional rights to private photographs, artwork, logos, or personalization materials submitted solely for order fulfillment.

21. Website Availability and Disclaimer

We aim to keep our website and ordering systems available and accurate, but uninterrupted operation cannot be guaranteed.

The website may occasionally be unavailable because of maintenance, technical failures, third-party service interruptions, security issues, updates, or circumstances outside our reasonable control.

We may modify, suspend, or discontinue website features when reasonably necessary.

To the extent permitted by applicable law, the website and its informational and technical features are provided on an “as available” basis. Fennec Creations does not guarantee that the website will operate without interruption, error, or incompatibility with every device, browser, or third-party service.

This provision concerns the website and digital services. It does not eliminate product warranties, customer remedies, representations made about purchased goods, or other obligations that cannot legally be excluded.

22. Limitation of Liability

To the fullest extent permitted by applicable law, Fennec Creations will not be liable for indirect, incidental, special, or consequential losses arising from use of the website or services when those damages may lawfully be limited.

Any limitation relating directly to purchased goods or an order applies only to the extent permitted by applicable law.

Nothing in these Terms is intended to exclude or limit liability that cannot lawfully be excluded or limited.

23. Customer Responsibility for Infringing Content

To the extent permitted by law, you are responsible for reasonable losses or costs arising directly from a third-party claim caused by content or specifications that you knowingly submitted for production without the rights or authority necessary for Fennec Creations to use them as requested.

This provision is intended primarily to address copyright, trademark, privacy, publicity, and similar claims involving customer-supplied materials.

It does not excuse Fennec Creations from responsibility for its own unlawful conduct.

24. Events Outside Reasonable Control

Fennec Creations will not be responsible for delay or inability to perform caused by circumstances outside our reasonable control to the extent permitted by law.

Examples may include severe weather, natural disasters, carrier disruptions, power or internet outages, widespread equipment or service failures, government actions, emergencies, supply-chain interruptions, or labor disruptions.

When such circumstances affect an order, we will make reasonable efforts to communicate with the customer and will continue to comply with applicable shipping-delay, cancellation, and refund requirements.

25. Governing Law and Disputes

Except where applicable law requires otherwise, these Terms and transactions governed by them are interpreted under the laws of the State of Texas, without regard to conflict-of-law principles.

We encourage customers to contact Fennec Creations first when a problem arises so we have an opportunity to review and resolve the issue.

Any legal proceeding must be brought in a court having appropriate jurisdiction and venue under applicable law.

Nothing in these Terms requires a consumer to bring or defend a claim in a forum that applicable law does not permit.

26. Changes to These Terms

Fennec Creations may update these Terms as our products, services, technology, business practices, or legal requirements change.

Updated Terms will be posted with a revised Last Updated date.

Changes generally apply prospectively. Terms governing an order already accepted will not be materially changed after the fact unless the customer agrees or applicable law otherwise permits or requires the change.

27. Severability and No Waiver

If any provision of these Terms is determined to be invalid or unenforceable, that provision will be interpreted or limited to the extent permitted by law, and the remaining provisions will continue in effect.

If Fennec Creations does not enforce a provision in one circumstance, that does not necessarily waive our right to enforce it in another circumstance.

28. Entire Agreement and Order of Precedence

These Terms, together with incorporated policies and applicable order-specific terms, govern the relevant use of our website and purchase of Fennec Creations products.

Applicable documents may include:

• these Terms of Service;
• the Return & Refund Policy;
• the Shipping Policy;
• the Privacy Policy; and
• an accepted quote, invoice, proof, order agreement, or other special-order terms.

If accepted order-specific written terms expressly conflict with these general Terms, the order-specific terms govern that particular order to the extent of the conflict.

If a purchase is made through a third-party marketplace and mandatory marketplace requirements conflict with these Terms, those requirements control to the extent of the conflict.

Mandatory rights provided by applicable law remain unaffected.
